Rental PolicyEligibility:Salem Art Association offers a number of works for rent (for a three-month
period) to current members (with dues up to date) who have not defaulted
on any returned rentals, rental charges and/or payments on purchases through
the Salem Art Association within the past year. (See "Failure
to return artwork") Business members may rent work for their place of business. No employees of business members are allowed to rent work for personal use under the membership of their employer. Artwork available:Artist showing in the Sales/rental gallery have a choice whether or not they wish to allow their work to be rented. If the work is available to rent, it is noted on the artwork's label. Artwork rental is NOT to be renewed for a second 3-month period, as this would remove the work from the public market and the artist's access for half a year. Fees:Works are offered for a three-month rental period at the following rate:Pieces that have a retail price of $100-$499 will rent for $40 (per work). The rental fees for the 3-month period may be applied toward the purchase of the rented pieces before or on the date they are due back to gallery. Late charges of $1/day will be added to charges until the artwork is returned. Purchase of rental work:Members purchasing their rentals are entitled to the 10% discount. If the renter wishes to purchase the artwork at any time up to and including the return due date, the rental charge will be applied to the purchase price. If the work is purchased after the due date, rental charges paid on the work are not applied to the purchase of the work. Failure to return artwork:RENTALS MAY NOT BE RENEWED. Artwork rented through the Bush Barn Art Center belong to the artist; timely returns are very much appreciated by both artists and the Association. If the renter fails to return the artwork upon due date, it is understood that the renter is responsible for a charge of one dollar ($1) per piece for each day the work(s) is overdue, plus any cost or expense incurred by the rental/sales gallery in recovering possession. Renters not purchasing or returning work on the due date forfeit the application of rental fees toward the purchase as well as the 10% member discount on the rental pieces. If the renter has not returned the work (and paid late charges) within a one-month grace period, the renter is considered in default. At that time, unless the renter has made special arrangements with the Association due to unusual circumstances, the renter will be charged late fees and full purchase price as per the agreement. Members who have defaulted on timely rental return may resume participation in rental program after a one-year probation period. Additional conditions of rental agreement:The renter should read the contract thoroughly and ask for clarification before signing. The rental works shall be kept at the address that is listed under the membership. The renter cannot sublease the artwork or assign the lease. Works are released in good condition. Any minor flaws in condition are noted on the rental agreement by the clerk at the time of rental, before the agreement is signed. The renter agrees to return it in the same condition at the expiration of the lease. The renter shall not clean, repair, remove from its frame or base, or in any other way alter the artwork. Acceptance by the agent of the Rental/Sales Gallery of the return of the article shall not be construed as a waiver of any claim it may have for damage to the article prior to the return. Transportation of the artwork to and from the Gallery is the responsibility of the renter, and suitable precautions shall be observed in transit. The renter's insurance must cover the artwork in case of damage or theft. |
