NOTES:
1860 Marion Co. census lists J. McBee, 40, farmer, b. OH DLC #1224 Married Sarah Matheny, 7/13/1845, Ray Co., Missouri; "Captain of Militia in pioneer Missouri during the Mormon troubles. He left Missouri on accounty of slavery." Mar. Co. Adm. Notice of estate 19 Feb to 5 Mar 66, F. M. Rice, admin. "Four McBee brothers started from Missouri to Oregon with the 1852 covered wagon immigration; two, Levi and Thomas, died on the plains, and John became a prominent pioneer here. The other brother, William, spent the first winter in Marion county and settled in Benton county, seven miles south of Corvallis. John McBee started across the plains, he put $5,000 into his outfit; had 16 yoke of oxen and four wagons. So many men of John McBee's company started across the plains poorly equipped, or suffered losses on the way that, out of the 16 yoke of good oxen and four large, fine wagons with which he started, when he arrived at The Dalles he had two wagons and only two yoke of oxen. He did not have the heart to refuse aid to unfortunate fellow travelers on the way, even though impoverishing himself. At The Dalles, he traded a yoke of oxen and $10 in money for a sack of flour. The whole company unloaded the heavier freight and took it down the Columbia on a raft. The raft struck a rock in the stream and the jar threw out part of the freight. In this way, the McBees lost a chest that contained the family records. The rest of the company came by way of the Barlow road over the Cascades and into the Willamette valley. The McBee family settled near Halls Ferry and after a year moved to the hills south of Salem, near Liberty. Lockley, 21 June 1922, Hendricks, 16, 17 Jan. 1935

She was born in Kentucky. My parents had four children when they started by ox team across the plains for the six-months trip to Oregon. John, who was about a year and a half old, died near the Blue mountains. Ellen, who was a few months old, died not far from where the city of Pendleton now is. Mother's brother, many years later, took the map mother had made showing the location of the graves of her two babies and went up there to put headstones on the graves. He could locate only one of the graves, and it was in a field planted to wheat, so he couldn't tell just where the grave was. My brother George, 6 and Francis, 4½ years old made the trip in safety. My sister Elisabeth was born in 1853, not long after they took up their donation land claim. I was the next child and was born in 1859." Sarah McBee Judson in interview with Fred Lockley

http://www.peak.org/~mransom/missionaries.html; Funeral ordered by McClane Bros;
OBITUARY:
HAS CROSSED PLAINS; Pioneer of 1840 and Last Survivor of Missionary Ship Lausanne.
Mrs. Helen C. McClane died at the residence of her son, L. B. McClane on Water street, at 1:10 o’clock this morning, from the result of an acute attack of erysipelas.
She was taken suddenly ill last Friday, and last Sunday the doctor announced that there was little hope, and her children were all summoned to her bedside. The end came very suddenly and was hardly expected last night.
Mrs. McClane was one of the earliest pioneers of Oregon, having come to this country in 1840. She is the last survivor of those who came to Oregon on the missionary ship Lausanne, which landed at Astoria in the spring of 1840. She was born in Otsego county, New York, April 14, 1834.
After their arrival in Oregon they first settled at the mission below Salem, soon afterward moving to this city, where she lived the remainder of her life. Her father built the house in 1841, which is the oldest now standing in the city, which is now occupied by Judge R. P. Boise. In 1843 she was married to the late JH. B. McClane. She was a lifelong member of the Methodist Episcopal church in this city, and was a charter member of the Oregon Pioneer Society.
About five years ago she was thrown from a buggy and has ever since been paralyzed on the left side. Last summer she suffered another fall and since that time was very weakly. She spent the past summer in Tillamook county with her son, C. H. McClane.
Deceased leaves one daughter, Mrs. J. H. McCormick, of Salem, and six sons, G. F. McClane, Portland, L. B. McClane, James L. McClane and John B. McClane, of Salem. O. H. McClane, Grand Ronde, and Harold G. McClane, Portland.
The funeral services will probably be held some time next Friday, but definite arrangements will be announced later.

Oregon Statesman 22 Jan 1892 6:5

ONE OF THE EARLIEST PIONEERS.
Death of Hon. J. B. McClane, Founder of North Salem and Salem's First Postmaster.
The funeral of Hon. J. B. McClane, who died at his home in North Salem early Thursday morning, was conducted from the family home, on his original donation land claim yesterday afternoon, with service at the house, conducted by Rev. Robt. Whitaker. The body was given interment in the I.O.O.F. Rural cemetery, and was followed to the grave by a large number of friends who deeply sympathize with the family in the loss they have sustained.
Mr. McClane was one of Salem's earliest settlers--in fact, he might be termed the founder of Salem, for it was his mill that in the early days demonstrated more than anything else that this was the place for the building of a city. This grist mill occupied the site which in later days became known as the woolen mill property.
John Burch McClane was born in Philadelphia on Jan. 21, 1820, where he resided until he attained his majority. He was a member of a company of men who started to take part in the Mexican war. The party broke up and all but Mr. McClane returned to Philadelphia. He got as far back as Iowa, where he spent the winter of 1842-43. He came to Oregon in the spring of 1843, driving the first wagon from Fort Hall to Oregon. Arriving in Oregon, Mr. McClane came to Salem and took as a donation land claim( 320 acres) the present site of North Salem. He went to the Cayuse war in 1847, and returned with the party detailed to escort the body of Col. Gilliam to the valley. This memorable trip they made by boat, descending the rapids of the Columbia. In the fall of 1848, Mr. McClane went to California, attracted by the excitement attending the finding of gold, and returned to Oregon in May, 1849. On his return he bought a stock of general merchandise, with which he conducted a store at Salem. This was the second store started here.
On May 9, 1849, the subject of this sketch was married at Salem to Helen C. Judson, daughter of Rev. L. H. Judson, one of the early missionaries.
As a public servant Mr. McClane honorable filled many positions of trust in the gift of the government and the people. He was Salem's first postmaster, having received the appointment at the hands of the postal agent at San Francisco in 1850. He was elected county treasurer the same year, and in 1853 he returned to the Atlantic coast, where he remained three years. Again in 1861 he was appointed postmaster. From 1865 to 1872 he was state librarian, for ten years he served as bailiff of the supreme court, and from 1885 to 1889 he served as agent at the Grand Ronde Indian agency. Nine children--six sons and three daughters--are left to mourn with their mother the death of father and husband. The sons are: Geo. F., of Portland; L. B., J.L., and C.H., and two minors, H. G. and J. B. Jr., of Salem. The daughters are Mrs. J. H. McCormack, Salem; Mrs. S. Matheney, of Gaston; and Mrs. P. Grimm, of Nestucca.

OBITUARY:
JOHN M'COURT PASSES AWAY, Youngest Justice of Supreme Tribunal of State Succumbs to Illness.
Justice John McCourt, of the Oregon supreme court, died at his home at 1311 Court street about 8 o'clock yesterday morning after an illness of nearly two weeks. A complication of ailments provoked by septic poisoning from infection of the teeth, caused his death.
Justice McCourt is survived by his father and mother, Mr. And Mrs. Jame McCourt, of Albany, his widow and one son, John McCourt, of Salem; two brothers James H. McCourt, now in Montana, and Aubrey McCourt of Albany; and five sisters, Minnie, Edith and Gladys, of Albany, Frances, of Portland and Emma, now in California.
Out of respect to Justice McCourt the supreme court adjourned yesterday morning and will not be in session until Monday after the funeral.
The funeral will be held Monday at 10:30 o'clock a.m., at the First Presbyterian church of Salem, with Rev. W. W. Long, pastor of the church, and a Presbyterian minister from Portland officiating. Interment will be in IOOF cemetery. High tribute to Justice McCourt were paid today by Governor Pierce and Chief Justice McBride of the supreme court.
"I first knew Judge McCourt as a member of the legislature from Marion county," said Governor Pierce, "He and I practiced law in Pendleton at the same time and often were arrayed against each other in the trial of cases. I knew him as a brilliant lawyer and always held him in the highest esteem. It is a distinct loss to Oregon to lose Judge McCourt at this early period in his life. My relations with him in a personal, legal and official way were always of the pleasantest and I counted him one of my warmest and dearest friends."
Chief Justice McBride said; "The death of Justice McCourt comes as a shock to all of us. The youngest member of the court, he had early forged ahead to the position of one of its ablest and most influential members. He has demonstrated his great ability in every walk of the profession==as a legislator, as United States district attorney, as circuit judge, and on the bench he demonstrated his talents as a lawyer of high abilities and as a judge whose clear insight into difficult questions always commanded respect and admiration.
"His relations with his associates were too intimate and tender to speak of in this early hour of bereavement. We mourn his loss as that of a brother and a friend. His family has lost a dear and affectionate husband and father. This court has lost a beloved associate. The state has lost an able and conscientious official. I cannot say more."
Justice McCourt was 50 years old. He was born in Listowel, Canada, February 26, 1874, but in his infancy moved with his parents to California. He received his early education in the public schools of California and Oregon, the family moving to Oregon in 1890.
Judge McCourt attended Willamette university taking a year in the literary course and then entering the law department of Willamette, from which he was graduated in 1896. In June of that year he was aadmitted to the bar.
Mr. McCourt was married in 1898 to Mis Vera Boothby, daughter of Mr. And Mrs. W. F. Boothby. The Boothby family was one of the prominent Salem families, Mr. Boothby having done notable work in the construction of public and business buildings. Mr. McCourt was elected in 1898 as one of the Marion county representatives in the legislature, serving in the special session of that year and in the regular session of 1899. He practiced law in Salem until 1900 when he moved to Pendleton and practiced his profession. He served as deputy district attorney at Pendleton from 1905 to 1908. In March, 1908, he was appointed by President Roosevelt as United States attorney for Oregon and moved to Portland. He resigned this position in 1913 and entered upon private practice in Portland as a member of the law firm of Veazie, McCourt & Veazie.
Governor Olcott appointed Mr. McCourt to a circuit judgeship in Multnomah county in November 1918 to succeed the late Judge C. U. Gantenbein, and he was subsequently elected to succeed himself in that office. When a vacancy on the supreme bench resulted by the resignation of Justice Charles A. Johns, Governor Olcott appointed Judge McCourt as a justice of the supreme court October 8, 1921. He was then elected to the office in November, 1922.
In politics Justice McCourt was a Republican. He was a member of the Presbyyterian church, but had no fraternal affiliations. Oregon Statesman 13 September 1924 1:7, 3:6
