OBITUARY:
PROMINENT FRUIT MAN PASSES AWAY.
C. [sic] M. Aspinwall well known in county and owner of fine ranch.
A. M. Aspinwall, one of the best known fruit growers and president of the Brooks Fruitgrowers association, died at 4 o'clock yesterday afternoon in Portland at the age of 52 years.
He had been a resident of Oregon about six years, coming here from Manchester, S. D. He owned a 21 acre farm at Brooks which is devoted principally to fruit culture. He gained a wide reputation with his fruit growing and was made president of the association at Brooks because of his success. The association handles loganberries principally. He is survived by a wife and 11 children, nine sons and two daughters.
The funeral will probably be held at 10 o'clock Wednesday from the home in Brooks. Burial at Odd Fellows cemetery in Salem.

At the home of her son-in-law and daughter, Mr. and Mrs. Squire Farrar, this city, Wednesday evening, January 15th, 1890 , Mrs. Lydia Atkinson, in the eighty-second year of her age.
Deceased was born in Leeds, Yorkshire, England, and came to the United States when about 18 years old. She resided in Salem up to the time of her death. She leaves three daughter, Mrs. Johnson, living in St. Louis, Missouri; Mrs. Fortner, in Portland, Oregon, and Mrs. Squire Farrar, at whose home she died. Her husband has been dead since 1856. Due notice of her funeral will be given.

OBITUARY:
ATTERBURY -- At a local hospital in this city August 24, 1913. Arthur A. son of Mr. and Mrs. A.W. Atterbury of Tillamook, Or., aged twenty-two years.
The funeral was held from the Cottage undertaking parlors yesterday at 2 p.m. Interment was made in Odd Fellows cemetery. Deceased leaves a father, mother, two sisters and three brothers to mourn his loss.

OBITUARY:
DEATH of J. H. ATWOOD -- Occurred After a Long Illnes Tuesday. J. H. Atwood, who died at his home at Twenty-first and Mill streets Tuesday afternoon, has been a resident of Salem for nine years. He leaves a widow, Mrs. Martha Atwood, a son, C. J. Atwooe, a clerk in the Woolen Mill Store, and three daughters, Mrs. Anna D. Mc Pherson of University Park, Portland; Mrs. Linnie M. Lee and Miss Helen M. Atwood of this city. He had been a member and ardent worker in the Methodist church and Sunday school, teaching a bible class in the latter. He was born in Massachusetts on Nov. 24th, 1838 and was married in 1857. His profession was teaching, he having conducted schools in Enfield, Mass., Onarga, Illinois and Springfield, Mass.
Funeral services will be held at the family home Thursday at 10 a.m., conducted by Rev. John Parsons. Interment will be in the Odd Fellows' cemetery.

At her home, corner of High and Trade streets, at 6:30 p.m., Saturday, January 14, 1893, from heart disease, Mary Ann Avert. Mrs. Avert had been ill but a few days, and her death was wholly unexpected. During the afternoon yesterday she felt bad and rested on the sofa. At her request she was raised to a sitting position, when she fainted. Reviving, she felt considerably better. She was raised up again and fainted a second time and died after a few moments without regaining consciousness. Notice of the funeral will be given later.

CAPT. F. J. BABCOCK PASSES AWAY.
Death of the County Clerk of Marion County, After a Protracted Illness.
At 5:30 yesterday morning Capt. F. J. Babcock, county clerk of Marion county, yielded his life to the illness which had prostrated him for so many weeks, and a few hours later the fire alarm bell, tolling in measured, mournful tones, carried to the fire boys and the public news that one of their member had passed to that bourne whence no traveler returns. Capt. Babcock had been ill for many years and his death came as no surprise. Several times before he had been quite low and the end was expected, but each time he rallied sufficiently to be around and able to attend to business. When death came, it found Capt. Babcock surrounded by his family, who heard his last words, he retaining consciousness almost to the last and realizing that his lease of life was fast expiring.

Frelon J. Babcock was born in June 1843, at Burke, Vermont, and came of a family of soldiers, his great grandfather having been first lieutenant in the fourth division of Vermont artillery. Capt. Babcock entered the service on June 1, 1861, enlisting in Co., I, third regiment of Vermont infantry, which became a part of the Vermont brigade that did such noble fighting. On Oct. 23, 1862, he was discharged for disbility--pulmonary consumption--and it was thought then that he would never reach home alive. But his constitution was such that he rallied and on August 6, 1863, had so nearly regained his health as to be able to re-enlist, joining the same company and regiment. On Sept. 26, 1864, he was discharged as corporal, to accept promotion of first lieutenant in forty first U. S. colored troops. Until his final discharge on Sept. 30, 1865, he served as first lieutenant and also as adjutant in this company, participating during the service in the batles of the peninsula, at Fredericksburg. He was wounded at the Wilderness, and at Gettysburg he was in the reserve force. He was twice wounded--once in the arm and again in the leg--and was receiving a pension of $4 per month for wounds.
A MASON OF HIGH DEGREE
Capt. Babcock was a Mason of the 32d degree, Scottish rite, and was a member of the council of Royal and Select masons. He was made a Mason in Vermont and took most of the degrees in that state. Coming to Salem in the fall of 1868, he was one of the charter members of Pacific lodge, No. 50, of which he became the first worshipful master and was afterward several times re-elected. In 1879, he was elected grand secretary of the Grand lodge and served in that capacity during eight years. He was past eminent commander of Albany Knight Templar commandry and since last Tuesday was past recorder of the Grand commandry of Oregon, having held that office since the organization of that order in the state. His successor in office was chosen a week ago.
IN THE GRAND ARMY
One of the charter members of Sedgwick post, G. A. R., of Salem, Capt. Babcock was that post's first commander, having been elected to that position Sept. 26, 1882. He was re-elected in 1883, but soon after resigned, having been elected senior vice department commander of the G. A. R., of Oregon. In February, 1884, he was elected department commander, department of Oregon.
AS A PUBLIC SERVANT
Mr. Babcock served Salem during a part of one term as city treasurer, having been appointed to fill a vacancy. He was also at one time a member of the city council. In 1888 he was elected county clerk, and in 1890 was again the people's choice for the same position. After Mr. Babcock's arrival in Salem he entered into the manufacture of furniture, in connection with Mr. Parmenter, and in this business was actively engaged until elected county clerk.
In 1871 at Salem, Mr. Babcock was married to Ida M. Pratt, daughter of Capt. L. E. Pratt, who survives him. To them four children were born, the elder son living but a short time. The children surviving are: William, aged 15, Grace, age 12; and May 3 1/2 years. Mrs. John Gray, of this city, is a sister of Mr. Babcock.
The funeral, which will be conducted by the Masonic fraternity, will be at 2 o'clock Wednesday, from the family residence. The service will be by Rev. P. S. Knight, and the remains will be interred in the Rural cemetery. Oregon Statesman, Nov. 3, 1891; 4:3.

FUNERAL of CAPTAIN BABCOCK
It Will Be Conducted by the Masonic Order from the Congregational Church Today.
At 2 p.m. today, the funeral of the late Capt. F. J. Babcock will be conducted from the Congregational Church. The services will be conducted by Rev. P. S. Knight, who will be assisted by Rev. C. L. Corwin. The ceremonies at the grave will be under the auspices of the Masonic order, Grand Master Brennan Van Dusen, of the Grand lodge of Oregon, conducting the service at the grave. The Masonic order of the city will assist in the exercises, and a considerable escort of the commandry and the grand lodge is expected to assist. The casket will open at the home from 9 to 12 o'clock today, but it will not be opened at the church.
PACIFIC LODGE
A special meeting of Pacific lodge, No. 50, A. F. & A. M. is called for 12:30 today. Masons in good standing will be present to attend the funeral in a body.

Mrs. Ida Babcock Dies at Age 88 -- Funeral Set Tuesday for Well-Known Pioneer Resident Here -- Mrs. Ida Maria Babcock, prominent Salem pioneer resident, died yesterday noon following a long illness at her family residence, 749 North Commercial street. She was 88 years old. Services will be held from the Clough-Barrick chapel Tuesday, January 24, at 1:30 p.m., with burial at IOOF cemetery, Dr. W. C. Kantner and Rev. Robert Hutchinson will have charge.
Father and Husband Prominent
She was born in South Kingston, Rhode Island, June 13, 1850, and was the daughter of Capt. and Mrs. Emily Pratt. Her father brought the family to Oregon while she was a young girl, Capt. Pratt established the first woolen mill in Salem and was a well-known river boat captain.
On March 8, 1871, she was married to Freeland J. Babcock, former Marion county clerk. Her husband served as a captain in the civil war and was a prominent Masonic member. Of their four children, two survive, Miss Grace Babcock of Salem and Mrs. C. A. Maulding of Ocean Lake. Two sons are deceased, Pratt Babcock and William Paul Babcock who died in 1924.
Active in Club Work
Mrs. Babcock was long a member of the First Congregational church. She was a charter member of the Women's Relief corps and first department president of that organization. She was also a member of the Eastern Star, Past Matrons" association, White Shrine of Jerusalem, Old Timers' club and the Priscilla club.
Survivors include the two daughters, two granddaughters, Miss Bertha Babcock of Salem, Mrs. Oliver Jessup of Portland; niece, Mrs. Carrie Beechler.

Mrs. Bachman's death resulted indirectly from an accident about six weeks since in which she broke her thigh. A complication of disease set in, and she gradually sank till her death. She will be buried today (Saturday) at 2 o'clock p.m., from the residence, corner of Liberty and Union streets.

Blasius Grasser Charged With Second Degree Murder.
Elmer Bacon, Sixteen, While on Way to Chop Wood Monday, Across the River, Meets Sudden Death.
Shot by a neighbor who was guarding a newly posted "No Trespassing" sign, Elmer Bacon, 16 years old, lies dead at the county coroner’s office from the effects of the wounds received at 7:30 yesterday morning near the Blasius Grasser tract, six miles south of Salem. Grasser is in jail charged with second degree murder. The boy is the only son of Mr. and Mrs. Alva Bacon of Marion county, who have a ranch adjoining the Grasser property on the river road. Whistling When Death Comes.
With his father Elmer started early yesterday morning to cut wood on some adjoining land. Unusually happy and light hearted, the lad ran ahead of the father, singing and whistling. He reached the crossroads where a sign had recently been posted by a neighbor advising against
trespassing, and was about to climb over a fence next to it, which led to his work, when there was a report from a shotgun, and the boy fell with his back and left side of the face loaded with shot. The father picked up the boy and two neighbors. Knute Nelson and Andy Kohler, who heard the shot came to the scene and carried the boy to the Bacon home, where he died at noon. No one saw the shot fired, so far as can be ascertained.
Grasser Admits Shooting.
Sheriff Esch arrived on the scene later with Coroner Clough. The direction of some of the shot which had hit the post, was taken and being due north, it was traced to a corner of the Grasser tract, where gun wadding was found and where the tress had been bent and cut. Big boot footsteps were traced to the Grasser cabin. A neighbor named Misse said that Grasser had come to him a little earlier and asked him to take care of things as he, Grasser, was going away for a few days. Neighbors stated that Grasser said on Saturday that he would place trespassing signs and that he would shoot the first person he saw on the line. Grasser lives alone in his cabin. His wife died some years ago. His two daughters are in Germany. Taken into custody Grasser admitted the shooting.
Inquest Today.
An inquest will be held at the county coroner’s today at 1 o’clock. Grasser is in the county jail, where he is held with a charge of second degree murder.
The Bacon family is bowed in grief. This is the second of the family who has met a tragic death. Two years ago a daughter 13 years old died from the results of burns. Elmer Bacon, the oldest child and help of the family, was a big handsome boy, and the idol of his parents. Gun shot hit him on the left side of the body. The shot came from an old fashioned single barrel shotgun.

Funeral services over the 16-year-old lad, Harry Elmer Bacon, son of Mr. and Mrs. Alva Bacon of near Liberty, who died Monday from gunshot wounds, were held yesterday at 2 p.m. from the parlors of Lehman & Clough. Rev. F. T. Porter officiated. Interment was in the Odd Fellows’ cemetery. The pallbearers were boyhood friends of the lad who was so sadly a victim.

MANSLAUGHTER FOR GRASSER
Convicted of Killing Elmer Bacon January 4.
Crime Punishable by 5-15 years.
Will Be Sentenced Tuesday, January 26.
Manslaughter was the verdict returned against Blasius Grasser by the jury last night at 10:30 o’clock after over six hours deliberation. The crime of which Grasser was convicted was the killing of Elmer Bacon, a 16-year-old boy, near Liberty on January 4. The crime is punishable by five to fifteen years in the penitentiary. Grasser will be sentenced Tuesday, January 26, at 9 a.m.
According to the testimony of Alva Bacon, father of the boy, he and his son had started from their home about 7 o’clock in the morning to go to a tract where they were cutting wood. The boy was a short distance ahead of his father and was climbing over a fence where four tracts join, one of the tracts belonging to Grasser, when his father heard a shot, followed immediately by the boy saying "Oh". The father ran and found the boy lying on the land belonging to Knute Anderson, about five feet from the Grasser property. The boy had been shot with a shotgun in the left side of the face and body.
Father on Stand
Bacon, according to his testimony, called for help and a German whose name Bacon did not remember, a Mr. Anderson and a Mr. Miller came and helped carry the boy home, where he died about four hours later. Bacon stated that he was not personally acquainted with Grasser but knew him by sight. He said he had been cutting wood for about six weeks and had never seen any trespass signs on Grasser’s property. He also said that he and his son did not step on Grasser’s land in climbing the fence but crossed diagonally on the opposite side of a large oak post set where the four tracts cornered.
Heard Grasser Complain
Knute Anderson testified that he had heard Grasser complain of people breaking down his fence and heard him say that he would shoot any one trespassing. K. Louis Miller who lives at the Anderson home, corroborated Anderson’s testimony. Mrs. Knute Anderson also said she had heard Grasser make the threat New Year’s day.
S. H. Mize, another neighbor, said that he had heard Grasser state that he had been bothered by people crossing his property and breaking the fences. Mize said he had crossed the Grasser land, leaving the fence down, and that Grasser had asked him to cross in another place, but that he had Grasser had not quarreled.
Sheriff Gives Testimony
After the testimony of Dr. C. H. Robertson as to the cause of the young man’s death, Sheriff Esch was called and identified the gun offered as evidence. Sheriff Esch testified that when and Grasser were walking down the road after Grasser’s arrest that the latter admitted having fired the shot but said he did not know he had hurt anyone.
Sheriff Esch stated that in the presence of W. E. Needham, deputy sheriff, and E. R. Ringo, after Grasser had been brought in to the county jail Grasser said he had risen early and had gone down to the fence corner where he said he had posted trespass warning, and waited until he saw some one approach. He fired and without waiting to inspect the result of his shot went home and cooked breakfast.
Cooks Breakfast After Shooting
Grasser, who is a widower, lived alone and had very little to do with his neighbors. He is reported to have two daughters in Germany. He is about 50 years old. He testified, through an interpreter, Gus Heyden, and said in general that he had been bothered with people trespassing at various times for several years. He said after the shooting that he heard no outcry and did not know that he said after the shooting that he heard a yell when he had almost reached home, but did not investigate.
The case came up for trial Thursday and the greater part of the day was spent by the jury at the scene of the crime, about six miles southwest of this city. Alva Bacon, the first witness was called about 4:30 p.m. Thursday. Yesterday the court room was packed to the doors and many were standing in the corridors outside. When the case went to the jury practically all the spectators remained in their seats hoping the verdict would soon be returned. Only a few, however, were there when the jury returned.

Grasser Sentenced Today.
Blasius Grasser, convicted of manslaughter for the killing of Elmer Bacon, will be sentenced in department No. 1 of the circuit court this morning at 9 o’clock. The crime of which Grasser is convicted is punishable by a term of five to fifteen years in the penitentiary.

OBITUARY:
FRANCES ANNA EYERLY BADKIN -- May 21, 1916 -- Aug. 4, 1998 Frances Badkin, 82 of Salem died Tuesday. She was born in Salem and attended Salem High School and Oregon Business College. She married Harry Eyerly and was extremely active in his business ventures including car racing, boating and stunt flying and a car dealership. She was also a pilot and member of the Sports Car Club of America. She was a member of the Church of the Science of Mind. Her husband Harry Eyerly is deceased and her husband Lyle Badkin is also deceased. She was dedicated to helping animals. Survivors include her sons, Mike and Larry Eyerly, both of Salem; six grandchildren; and nine great grandchildren.
At her request no services will be held. Arrangements are by Virgil T. Golden Chapel. Contributions: Union Gospel Mission or Humane Society of the Willamette Valley.

Ambrie William Bagley, 85, of Salem died Wednesday. He was born in Hood River. He lived in Portland before coming to Salem in 1916. He graduated from Oregon State University in 1924. He owned and operated Field & Bagley Greenhouses in Salem, retiring in 1965. He was a member of Emmanuel Bible Church. Survivors include his daughters Ann Bagley of Salem and Lorraine Kelley of Yreka, Calif. Viewing will be from 9 a.m. to 1 p.m. today and 9 to 10:30 a.m. Saturday in Barrick mortuary, Salem. Graveside services will begin at 11 a.m. Saturday in Salem Pioneer Cemetery. Contributions may be made to the church memorial fund.

To Her Final Rest
The remains of Mrs. Annie M. Bagley, who died in Portland recently, of cancer, were brought to this city on the 11 o’clock train and were given burial at the Odd Fellows’ cemetery immediately afterward. Brief services were conducted at the graveside by Revs. T. F. Royal and W. F. Gordon. The deceased was formerly a resident of this city, was quite well known and highly respected, and was a widow of the late William Bagley, who preceded her to the grave six months ago. The deceased leaves one son, Alvin W. Bagley, of Portland.

OBITUARY:
Died--Bagley--In Salem, Thursday, July 13, 1893, Edith R., wife of W. H. Bagley, aged 23 years, 6 months and 4 days. Mrs. Bagley was sick about three weeks. She had trouble with her teeth which made it necessary to have several of them extracted and that was the beginning of difficulty that ended in blood poisoning and death at 6:50 o'clock last evening.
Deceased, whose maiden name was Pentland, was born at The Dalles February 9, 1870. When seven or eight years of age she went with her parents to Scio, which was her home until her marriage with Mr. Bagley February 12, 1889. In 1885 Miss Pentland entered Willamette university and two years later was graduated from the academic department and conservatory of music. Mrs. Bagley leaves a husband, a daughter 3 1/2 years old, her mother, Mrs E. E. Pentland, a sister, Miss Florence Reynolds, a step-sister, Mrs. S. L. Brooks of The Dalles and a step-brother, E. C. Pentland of Independence. She was a faithful member of the First Congregational church. Her many excellent traits of character, her genial and even temperament and her graces of mind and person made her hosts of warm friends at The Dalles, at Scio and in Salem where she was so well known.

OBITUARY:
At the home of J. P. Robertson, 406 Center street, Salem, Oregon, Tuesday, December 13, 1904, at 5 o'clock p. m., Mrs. Ellen Bagley, aged 74 years and 19 days, the immediate cause of her death being heart failure.
Deceased was born in Columbus, Ohio, on November 24, 1833. She had lived in the vicinity of Salem for many years, and during the past twelve years had resided continuously in this city.
In July of the present year she had a fall, in which she sustained a fracture of the thigh. She was confined in the hospital for a period of three months, but never fully recovered from the injury on account of her advanced age.
Mrs. Bagley was a devout Christian woman and an earnest church worker, being a member of the First M. E. church of this city. She leaves three sisters, besides a wide circle of friends to mourn her death. Her sisters are: Mrs. J. P. Robertson and Mrs. Workman, of Salem, and Mrs. Deardoff, of Oakland, Oregon.
The funeral services will be announced later.
